Bangladesh Parjatan Corporation Order, 1972 এর অধিকতর সংশোধনকল্পে প্রণীত আইন যেহেতু নিম্নবর্ণিত উদ্দেশ্যসমূহ পূরণকল্পে Bangladesh Parjatan Corporation Order, 1972 ( President’s Order No. 143 of 1972) এর অধিকতর সংশোধন করা সমীচীন ও প্রয়োজনীয়; সেহেতু এতদ্দ্বারা নিম্নরূপ আইন করা হইল:-
Section ১. সংক্ষিপ্ত শিরোনাম ও প্রবর্তন
(১) এই আইন Bangladesh Parjatan Corporation (Amendment) Act, 2022 নামে অভিহিত হইবে।
(২) ইহা অবিলম্বে কার্যকর হইবে।
Section ২. President’s Order No 143 of 1972 এর Article 2 এর সংশোধন
Bangladesh Parjatan Corporation Order, 1972( President’s Order No. 143 of 1972), অতঃপর উক্ত Order বলিয়া উল্লিখিত, এর Article 2 এর-
(ক) clause (b) এর পরিবর্তে নিম্নরূপ clause (b) প্রতিস্থাপিত হইবে, যথা:-
(b) “Chairman” means the Chairman of the Corporation;”;
(খ) clause (g) এর পর নিম্নরূপ নূতন clause (gg) সন্নিবেশিত হইবে, যথা:-
(gg) “President” means President of the Board;”;
(গ) clause (h) এর পরিবর্তে নিম্নরূপ নূতন clause (h), (i) এবং (j) প্রতিস্থাপিত হইবে,
যথা:-
“(h) “regulations” means regulations made under this Order;
(i) "rules" means rules made under this Order;
(j) “tourist” means a person who leaves his ordinary place of residence for a new place and stays there for a period not exceeding 1 (one) year for leisure, recreation, business or for any other reason, except for the purpose of employment for earning.”
Section ৩. President’s Order No 143 of 1972 এর নূতন Article 2A এর সন্নিবেশ
উক্ত Order এর Article 2 এর পর নিম্নরূপ নূতন Article 2A সন্নিবেশিত হইবে, যথা;-
“2A. Notwithstanding anything contained in any other law for the time being in force relating to tourism, the provisions of this Order shall prevail.”।
Section ৪. President’s Order No 143 of 1972 এর Article 4 এর সংশোধন
উক্ত Order এর Article 4 এর claude (1) এ উল্লিখিত “Dacca” শব্দের পরিবর্তে “Dhaka” শব্দটি প্রতিস্থাপিত হইবে।
Section ৫. President’s Order No 143 of 1972 এর Article 5 এর সংশোধন
উক্ত Order এর Article 5 এর clause (2) এর sub-clause (i) এর পর নিম্নরূপ sub-clause (ii) সন্নিবেশিত হইবে, যথা;-
“ (ii) to operate and manage duty free shops;”।
Section ৬. President’s Order No 143 of 1972 এর Article 6 এর সংশোধন
উক্ত Order এর Article 6 এর-
(ক) clause (1) এ উল্লিখিত” fifteen crore Taka” শব্দগুলির পরিবর্তে “one thousand crore Taka” শব্দগুলি প্রতিস্থাপিত হইবে; এবং
(খ) clause (2) এ উল্লিখিত “Taka five lakhs” শব্দগুলি এবং কমাগুলির পরিবর্তে “four hundred crore Taka” শব্দগুলি প্রতিস্থাপিত হইবে।
Section ৭. Presiden’s Order No 143 of 1972 এর Article 8 এর সংশোধন
উক্ত Order এর Article 8 এর পরিবর্তে নিম্নরূপ article 8 প্রতিস্থাপিত হইবে, যথা:-
8. There shall be a Board of Directors of the Corporation which shall consist of the following Directors, namely:-
(a) a person to be nominated by the Government for such period and terms and conditions as the Government may determine, who shall also be its President;
(b) Chairman of the Corporation;
(c) an officer not below the rank of Joint Secretary to be nominated by the Ministry of Civil Aviation and Tourism;
(d) an officer not below the rank of Joint Secretary to be nominated by the National Board of Revenue;
(e) an officer not below the rank of Joint Secretary to be nominated by the Legislative and Parliamentary Affairs Division;
(f) an officer not below the rank of Joint Secretary to be nominated by the Public Security Division;
(g) an officer not below the rank of Joint Secretary to be nominated by the Ministry of Environment, Forest and Climate Change;
(h) two Directors of the Corporation to be appointed by the Government;
(i) two representatives to be nominated by the Government from non-government organizations who are directly and institutionally associated with the tourism industry.
Section ৮. President’s Order No 143 of 1972 এর Article 9 এর প্রতিস্থাপন
উক্ত Order এর Article 9 এর পরিবর্তে নিম্নরূপ Article 9 প্রতিস্থাপিত হইবে, যথা:-
“9. (1) There shall be a Chairman and such number of Directors of the Corporation, as the Government may determine.
(2) The Chairman shall be the Chief Executive of the Corporation.
(3) The Chairman and the Directors shall be appointed by the Government for such period and on such terms and conditions as may be determined.
(4) The Chairman and the Directors shall be whole-time officers of the Corporation and shall exercise functions and discharge such duties as may be prescribed.”
Section ৯. President’s Order No 143 of 1972 এর Article 10 এর সংশোধন
উক্ত Order এর Article 10 এর-
(ক) প্রথম লাইনে উল্লিখিত “Director” শব্দটির পূর্বে “Chairman and a” শব্দগুলি সন্নিবেশিত হইবে;
(খ) sub-clause (d) এর পর উল্লিখিত “or” শব্দটি বিলুপ্ত ; এবং
(গ) sub-clause (e) এর পরিবর্তে নিম্নরূপ নূতন sub-clause (e), (f) এবং (g) প্রতিস্থাপিত হইবে; যথা:-
“(e) is declared as a defaulter by a competent court in repaying any loan taken by him from any bank or financial institutions;
(f) is engaged in any profession or business connected with the interest of the corporation directly or indirectly; or
(g) absents himself from 3 (three) consecutive meetings without reasonable excuse, the Government may remove him by an order.।”
Section ১০. President’s Order No 143 of 1972 এর Article 11 এর সংশোধন
উক্ত Order এর Article 11 এর-
(ক) clause (1) এর শর্তাংশ, clause (2), (3) এবং (4) এ উল্লিখিত “Chairman” শব্দটির পরিবর্তে “President of the Board of Directors” শব্দগুলি প্রতিস্থাপিত হইবে;
(খ) clause (2), (3) এবং (4) এ উল্লিখিত “ Director” শব্দটির পরিবর্তে “ Director of the Board” শব্দগুলি প্রতিস্থাপিত হইবে; এবং
(গ) clause (2 ) এ উল্লিখিত “one Director” শব্দগুলির পরিবর্তে “five Directors” শব্দগুলি প্রতিস্থাপিত হইবে।
১১| President’s Order No 143 of 1972 এর Article 16 এর সংশোধন
১১| উক্ত Order এর Article 16 এর clause (2) এ উল্লিখিত “Chartered Accountants Ordinance, 1961 (Ordinance X of 1961)” শব্দগুলি, কমা, সংখ্যাগুলি এবং বন্ধনীর পরিবর্তে Bangladesh Chartered Accountants Order, 1973(President’s Order No. 2 of 1972) শব্দগুলি, কমা, সংখ্যাগুলি এবং বন্ধনী প্রতিস্থাপিত হইবে।
