Registration (Amendment) Ordinance, 2026

Registration Act, 1908 এর অধিকতর সংশোধনকল্পে প্রণীত অধ্যাদেশ যেহেতু নিম্নবর্ণিত উদ্দেশ্যসমূহ পূরণকল্পে Registration Act, 1908 (Act No. XVI of 1908) এর অধিকতর সংশোধন সমীচীন ও প্রয়োজনীয়; এবং যেহেতু সংসদ ভাঙিয়া যাওয়া অবস্থায় রহিয়াছে এবং রাষ্ট্রপতির নিকট ইহা সন্তোষজনকভাবে প্রতীয়মান হইয়াছে যে, আশু ব্যবস্থা গ্রহণের জন্য প্রয়োজনীয় পরিস্থিতি বিদ্যমান রহিয়াছে; সেহেতু গণপ্রজাতন্ত্রী বাংলাদেশের সংবিধানের ৯৩(১) অনুচ্ছেদে প্রদত্ত ক্ষমতাবলে রাষ্ট্রপতি নিম্নরূপ অধ্যাদেশ প্রণয়ন ও জারি করিলেন:-

Section ১. সংক্ষিপ্ত শিরোনাম ও প্রবর্তন

(১) এই অধ্যাদেশ Registration (Amendment) Ordinance, 2026 নামে অভিহিত হইবে।

(২) ইহা অবিলম্বে কার্যকর হইবে।

Section ২. Act No. XVI of 1908 এর section 17A এর সংশোধন

Registration Act, 1908 (Act No. XVI of 1908), অতঃপর উক্ত Act বলিয়া উল্লিখিত, এর section 17A এর sub-section (2) এ উল্লিখিত “thirty” শব্দটির পরিবর্তে “sixty” শব্দটি প্রতিস্থাপিত হইবে।

Section ৩. Act No. XVI of 1908 এর section 26 এর সংশোধন

উক্ত Act এর section 26 এর clause (b) তে উল্লিখিত “four” শব্দটির পরিবর্তে “six” শব্দটি প্রতিস্থাপিত হইবে।

Section ৪. Act No. XVI of 1908 এর section 52A এর সংশোধন

উক্ত Act এর section 52A এ-

Section ৫. Act No. XVI of 1908 এর section 68 এর সংশোধন

উক্ত Act এর section 68 এর sub-section (2) এর পর নিম্নরূপ নূতন sub-section (3) সংযোজিত হইবে, যথা:-

“(3) Where it is found upon inspection or otherwise that a document has been registered by a Registering Officer with improper fees, taxes, service charges or duties, it shall be deemed to be a misconduct and the unpaid amount of fees, taxes, service charges or duties shall be realized from the concerned Registering Officer.”।

Section ৬. Act No. XVI of 1908 এর section 72 এর সংশোধন

উক্ত Act এর section 72 এর sub-section (1) এর পর নিম্নরূপ নূতন sub-section (1A) সন্নিবেশিত হইবে, যথা:-

“(1A) An appeal filed under sub-section (1) shall be disposed of by the Registrar within forty-five days from the date on which it is filed.”।

Section ৭. Act No. XVI of 1908 এর section 73 এর সংশোধন

উক্ত Act এর section 73 এর sub-section (2) এর পর নিম্নরূপ নূতন sub-section (3) সংযোজিত হইবে, যথা:-

“(3) An application filed under sub-section (1) shall be disposed of by the Registrar within thirty days from the date on which it is filed.”।

Section ৮. Act No. XVI of 1908 এর section 74 এর সংশোধন

উক্ত Act এর section 74 এ উল্লিখিত “conveniently” শব্দটি বিলুপ্ত হইবে এবং “may be,” শব্দগুলি ও কমার পর “having regard to the period stated in sub-section (3) of section 73,” শব্দগুলি, কমা ও বন্ধনী সন্নিবেশিত হইবে।

Section ৯. Act No. XVI of 1908 এ নূতন PART XIIA section 77A এর সন্নিবেশ

উক্ত Act এর section 77 এর পর নিম্নরূপ নূতন PART XIIA ও Section 77A সন্নিবেশিত হইবে, যথা:-

“PART XIIΑ

Of E-REGISTRATION

77A. Applicability of this Act to digitized registration system.-(1) Notwithstanding anything contained in any other provisions of this Act, a document may be registered digitally in the manner prescribed by rules by using any software approved by the Government for presentation of documents, admitting documents for registration, registration of documents and matters incidental thereto.

(2) For carrying out the purposes of sub-section (1), the Government shall make rules by notification in the Official Gazette.”।

Section ১০. Act No. XVI of 1908 এর section 80 এর প্রতিস্থাপন

উক্ত Act এর section 80 এর পরিবর্তে নিম্নরূপ section 80 প্রতিস্থাপিত হইবে, যথা:-

“80. Fees etc. payable on presentation. (1) All fees, taxes, service charges and duties under this Act and any other laws for the time being in force for the registration of documents shall be payable on the presentation of such documents and the Registering Officer shall realize the same.

(2) The Government shall by notification in the Official Gazette, make rules regarding the procedure of realization of fees, taxes, service charges and duties and regarding the use of the service charges realized under this chapter.”।
