Protection and Conservation of Fish (Amendment) Ordinance, 2026

Protection and Conservation of Fish Act, 1950 এর অধিকতর সংশোধনকল্পে প্রণীত অধ্যাদেশ যেহেতু নিম্নবর্ণিত উদ্দেশ্যসমূহ পূরণকল্পে Protection and Conservation of Fish Act, 1950 (Act No. XVIII of 1950) এর অধিকতর সংশোধন করা সমীচীন ও প্রয়োজনীয়; এবং যেহেতু সংসদ ভাঙ্গিয়া যাওয়া অবস্থায় রহিয়াছে এবং রাষ্ট্রপতির নিকট ইহা সন্তোষজনকভাবে প্রতীয়মান হইয়াছে যে, আশু ব্যবস্থা গ্রহণের জন্য প্রয়োজনীয় পরিস্থিতি বিদ্যমান রহিয়াছে; সেহেতু গণপ্রজাতন্ত্রী বাংলাদেশের সংবিধানের ৯৩ (১) অনুচ্ছেদে প্রদত্ত ক্ষমতাবলে রাষ্ট্রপতি নিম্নরূপ অধ্যাদেশ প্রণয়ন ও জারি করিলেন, যথা:-

Section ১. সংক্ষিপ্ত শিরোনাম ও প্রবর্তন

(১) এই অধ্যাদেশ Protection and Conservation of Fish (Amendment) Ordinance, 2026 নামে অভিহিত হইবে।

(২) ইহা অবিলম্বে কার্যকর হইবে।

Section ২. Act No. XVIII of 1950 এর section 2 এর সংশোধন

Protection and Conservation of Fish Act, 1950(Act No. XVIII of 1950), অতঃপর উক্ত Act বলিয়া উল্লিখিত, এর section 2 এর clause (7) এর প্রান্তস্থিত "." চিহ্নের পরিবর্তে ";" চিহ্ন প্রতিস্থাপিত হইবে, এবং অতঃপর নিম্নরূপ নূতন clause (৪) সংযোজিত হইবে, যথা:-

"(8) "Water body" means any river or stream, estuary, canal, beel, haor, baor, lake, spring, or any similar nature or water-holding area, including dighi, pond, ditch, enclosure (gher), pit land, water-rich area, floodplain, borrow pit, and wetland either perennial or seasonally inundated or submerged."I

Section ৩. Act No. XVIII of 1950 এর section 3 এর সংশোধন

উক্ত Act এর section 3 এর sub-section (3) এর-

"(i) declare Aquatic Other Effective Area-based Conservation Measures (OECM) for the purpose of conservation and sustainable management of aquatic biodiversity within OECM areas.

Explanation. For the purposes of this clause, "Other Effective Area based Conservation Measures (OECM)" in aquatic environment means a geographically defined area within the aquatic environment, other than a protected area, which is governed and managed in such a manner as to achieve positive and sustained long-term outcomes for the in situ conservation of aquatic biodiversity, together with the associated ecosystem functions and services, and, where applicable, cultural, spiritual, socio-economic, and other locally relevant values."

Section ৪. Act No. XVIII of 1950 এ section 4B সংযোজন

উক্ত Act এর section 4A এর পর নিম্নরূপ নূতন section 4B সংযোজিত হইবে, যথা:-

"4B. Sustainable Fisheries Management, etc. (1) Government may undertake measures in water-bodies regarding sustainable fisheries production, management and conservation.

(2) The Government may take action against the damage or destruction of fisheries ecosystems in beels, haors, baors, inland, and, coastal water bodies."
