The Bangladesh Industrial Development Corporation Order, 1972 (President's Order)
WHEREAS it is expedient to provide for the establishment of an Industrial Development Corporation for the purpose of taking over the assets of the East Pakistan Industrial Development Corporation and for matters ancillary thereto;
WHEREAS it is expedient to provide for the establishment of an Industrial Development Corporation for the purpose of taking over the assets of the East Pakistan Industrial Development Corporation and for matters ancillary thereto; NOW, THEREFORE, in pursuance of the Proclamation of Independence of Bangladesh, read with the Provisional Constitution of Bangladesh Order, 1972, and in exercise of all powers enabling him in that behalf, the President is pleased to make the following Order:
(1) This Order may be called the Bangladesh Industrial Development Corporation Order, 1972.
(2) It extends to the whole of Bangladesh.
(3) It shall come into force at once and shall be deemed to have taken effect on the 26th day of March, 1971.
(1) On the commencement of this Order, there shall be established a corporation to be called the Bangladesh Industrial Development Corporation.
(2) The Corporation shall be a body corporate having perpetual succession and a common seal with power, subject to the provisions of this Order, to acquire, hold and dispose of property, both movable and immovable, and shall by the said name sue and be sued.
(3) The head office of the Corporation shall be at Dacca.
In all matters relating to the Bangladesh Industrial Development Corporation, the provisions of the Provincial Industrial Development Corporation (East Pakistan) Ordinance, 1962 (Ord. No. XXXVII of 1962) and the rules and regulations made thereunder shall, subject to the provisions of this Order and the amendments specified in the schedule to this Order, apply.
Notwithstanding anything contained in the Provincial Industrial Development Corporation (East Pakistan) Ordinance, 1962 (Ord. No. XXXVII of 1962), as amended by this Order, or in any other law, rule or regulation for the time being in force, or in any contract, agreement or document, on the commencement of this Order,-
Provided that the disputes in respect of which such arbitration proceedings were instituted may be settled by such means as may be determined by an agreement between the Bangladesh Industrial Development Corporation and the party concerned;
15. The East Pakistan Industrial Development Corporation shall, on the commencement of the Bangladesh Industrial Development Corporation (Amendment) Order, 1972 (P. O. No. 78 of 1972), stand dissolved.
